Council granted a request by third party homeowners’ associations to intervene in the Council hearings related to the vested rights application and appeal of an administrative decision pertaining to The Brooks Town Center. Representing the homeowners’ associations was Beverly Grady, Roetzel & Andress, LPA.
The presidents of the four Brooks homeowners’ associations – Copperleaf Golf Club, the Harbour Club at Lighthouse Bay, Spring Run Golf Club and Shadow Wood Community Association – spoke in support of retaining the Town Center commercial uses.
Quasi-Judicial Hearings
Brooks Town Center – Vested Rights Determination
Council conducted a quasi-judicial hearing for The Brooks Town Center, pertaining to a vested rights determination for Long Bay Partners LLC (the property owner), PAC Estero Apartments, LLC, and TOP-CR Associates, LLC.
Public Comment: 2 residents spoke, eComment cards from 5 residents, and a community letter signed by 2405 residents of The Brooks communities were placed into the record supporting denial of the vested rights and the appeal.
Council voted to acknowledge vesting for the use of “multi-family low-rise” by Long Bay Partners, LLC only. No vested rights exist for a specific number of units, nor for a staff final plan approval process.
Brooks Town Center – Appeal of Administrative Decision by staff
The applicants were appealing the staff administrative action related to the correct process for filing an application for the proposed multifamily project. Their proposal is to demolish the now vacant Winn Dixie structure in the shopping plaza, leave the remaining retail buildings, and develop a 154-multifamily four-story building in the parking lot area.
Public Comment: Two intervenor representatives from the Brooks spoke in favor of conducting a public hearing should the applicant proceed to propose this redevelopment.
Council voted to affirm the staff decision.
