Construction Site

stormwater and constructionAny construction site that disturbs 1 acre of land or more is required to obtain an NPDES permit for construction.  This includes construction sites that might disturb less than 1 acre but is a part of a larger development or project.

A permit must be obtained from FDEP for these construction activities.  A Notice of Intent (NOI) and permit fee must be submitted to FDEP.

A Stormwater Pollution Prevention Plan (SWP3) must be created and kept with the permit when received.  Guidance on creating a SWP3 can be found at:

This SWP3 will be reviewed by Village staff as part of the Development Order process.

Industrial Sites

Certain industrial sites that are specifically identified with FDEP rules are required to obtain a Multi-Sector NPDES Permit.  The list of industrial activities that require an NPDES permit can be found at 40 CFR 122.26(b)(14).

Applicants must submit a Notice of Intent (NOI) and a fee to FDEP by mail.
