This agreement allows the Village control of the floodways for flood mitigation.
The Village has been working toward consolidating and better managing major stormwater retention projects under the Village’s stormwater permits with the Water Management District. T&T Umbrella Association, Inc., is an entity created to own and manage the stormwater storage facility located adjacent to the Hertz Arena, and holds the related Water District permits. T&T has agreed to transfer the facility, and related adjacent roadways and easements to the Village at no cost.
Council reviewed and approved the agreement to transfer ownership of the T & T Water Management System and dedication and conveyance of related roads to the Village. Costs associated with the maintenance and operation of the facility will be shared with KTB Florida Sports Arena, LLC, which operates the arena located north of the retention lake.
Included in the Council’s vote was the supplement to the agreement to allow the Village to acquire 100% of the stormwater management facilities serving the Hertz Arena and other proximate properties, and allowing the Village to share maintenance costs with KTB. Total costs are expected to be approximately $120,000 per year for maintenance.
Sovereignty Submerged Lands easement
Council approved the one-time payment of $739.88 to the Department of Environmental Protection for a 10-foot-wide easement under the Estero River for the Sunny Grove subaqueous force main.
Sunny Grove is located on the west side of US 41, just north of the Estero River. The closest exiting sewer force main is located along the north side of Corkscrew Road. The proposed force main will cross under the Estero River. The Estero River is considered Sovereignty Submerged Lands, which means it is owned by the State of Florida. Any crossing over or under the river requires approval by the State and a sovereignty submerged lands lease.
This is associated with the Village’s design and permitting for the extension of public utilities to the Estero Bay Village, Sunny Grove, and Cypress Bend communities.
