Resolution 2023-02 – Demolition of Village owned structure

8801 Corkscrew Road prior to Hurricane Ian

Council voted to adopt this resolution pertaining to the demolition of the property at 8801 Corkscrew Road, commonly known as the Dauray home.  The structure has been inspected and found to be structurally unsound, with additional damage from Hurricane Ian, which would be very costly to repair.  In addition, it was evaluated for its historic value and deemed to have no historical value.  Any salvaged elements will be conveyed to third parties in the Village’s best interests.

Public Comment: The president of the Estero Historical Society spoke, agreeing that the structure would be too costly to bring up to ADA standards.

Hurricane Ian funding agreement

Council voted to authorize Village Manager Steve Sarkozy to execute the federally funded subaward and grant agreement for Hurricane Ian between the Village and the State of Florida.  This agreement will allow the Village to be reimbursed for additional expenditures made pertaining to Hurricane Ian.

Estero on the River non-native plant treatments

The Village worked with an environmental consultant to prepare a scope of services for removing non-native and invasive plants from the Estero on the River property.  The large bamboo plants will be preserved.  Council voted to approve award of a Request for Bids to Milborne, LLC to provide the services at a grand total cost of $82,317.41, with a contingency fund amount of $8,230.

 

Agreement for land use and code enforcement special magistrate services

scales of lawThe Village can periodically procure, on a non-exclusive basis, the contractual services of qualified attorneys to serve as special magistrate to ensure that it has a sufficient number of magistrates. Since incorporation, the Village has had a contract with only one magistrate. Council voted that a contract be executed with a second, interim magistrate, Robert Pritt, for land use and code enforcement to ensure continuing services.

Ordinance 2023-02 – Land Development Code amendment

There was a first reading of this ordinance to add standards for development of elevated single-family homes so that they still fit in with their neighborhood.  Last November, the Village adopted updated floodplain regulations which included new FEMA maps. These maps revised floodplain areas and increased required elevations in certain areas. These new regulations result in additional fill needed, or raising homes on stilts to meet flood elevation requirements.

Public Comment: A resident stated that garages should be placed under the home on stilts.

Council passed this to a second reading on March 1, 2023.

Ordinance 2023-01 – International Design Center zoning

Miromar International Design Center plans to convert some of the building from design center retail to office space.  The design center has faced less demand than originally anticipated and greater vacancy rates, while the demand for office uses at this location remains high.  The current plan is to have a mix of both design center retail and office space.

The design center is located directly south of Corkscrew Road at the southeast quadrant of the Corkscrew Road-I-75 interchange.

Council voted to approve this ordinance with staff’s recommended conditions.
