It is the responsibility of a property owner to obtain permit(s) for all repairs or improvements which require a building or floodplain permit. In providing you with these responses, the Village relied on permit documents on file in its Building Department. It does not certify that a current or prior owner of the property did not perform unauthorized work without a permit. If this inquiry is being made in support of the transfer of title to property to a new owner, the intended new owner should take steps to verify that all necessary permits were obtained for any construction or land contouring work done on the property or any structures situated on the property. This caution is particularly relevant where a property has been in a flood area due to hurricane or other similar weather event such that structures on the property were likely submerged. The Village is obligated to FEMA to enforce its Building Code and Floodplain Code, and if the Village discovers (through actual inspection, reports of violations, or independent sources such as real estate listings) that a structure on the property has been repaired, rebuilt, or remodeled subsequent to a flooding event, and no corresponding permits were sought or issued, then enforcement would be taken against the new owner, who/which may be obligated to (at the least) apply for and receive after-the-fact permits, and possibly (if the improvements constitute substantial improvements or the estimated damage constitutes substantial damage) bring the structure up to current flood elevation regulations. This may require elevation of the entire structure or rebuilding of the entire structure. Properties that are sold “as is” can often be an indication of potential unreported flood damage or unpermitted work. Potential buyers are therefore urged to exercise caution and to conduct research (which may include seeking a third-party inspection of the structure prior to closing) to ensure they do not inherit such regulatory violations.
